Rehabilitation
i. Deemed Rehabilitation – A person who is inadmissible to Canada due to criminality may still be allowed to enter if they qualify for deemed rehabilitation. This applies when at least 10 years have passed since the completion of the sentence imposed, or since the offence was committed, provided the offence would be considered an indictable offence in Canada punishable by less than 10 years imprisonment.
ii. Individual Rehabilitation – Individual rehabilitation is a formal application process for persons who do not qualify for deemed rehabilitation but wish to overcome criminal inadmissibility. An applicant may apply if at least 5 years have passed since completing their sentence and they can demonstrate rehabilitation and that they no longer pose a risk. This may include proof of a stable lifestyle, community ties, social and vocational skills, or evidence that the offence was an isolated incident.
