Canadian immigration programs require employers to follow strict compliance regulations when hiring foreign workers. These rules ensure fair treatment, proper wages, and safe working conditions for all employees.

There are two main programs under which employers hire foreign nationals, each with its own compliance requirements:

Employer Compliance (Temporary Foreign Worker Program – TFWP)

The Temporary Foreign Worker Program (TFWP) allows Canadian employers to hire foreign workers to address labor shortages. Under this program, employers must first obtain a Labour Market Impact Assessment (LMIA) before the worker can apply for a work permit.

Employers are required to meet specific conditions, including offering appropriate wages, maintaining proper working conditions, and fulfilling all commitments made during the LMIA application. These obligations must be followed throughout the entire period of employment.

Employer Compliance (International Mobility Program – IMP)

The International Mobility Program (IMP) enables employers to hire foreign workers without requiring an LMIA. This includes categories such as Intra-Company Transfers and work permits under international agreements.

Even without LMIA requirements, employers must still comply with regulations related to wages, job roles, and working conditions during the employee’s tenure.

Inspections and Compliance Reviews

Employers who hire foreign workers under either TFWP or IMP may be subject to inspections or compliance reviews. These checks can occur at any time for up to six years after the work permit is issued.
